Privacy policy

1. Introduction

This Privacy Policy describes how Microbioflora Pty Limited, an Australian company trading as Progurt (“Progurt”, “we”, “us”, “our”) collects, uses, discloses and protects personal information when you visit progurt.com, create an account, place an order, use our quiz, subscribe, submit a review, or otherwise interact with us. This policy describes our practices; browsing the site is not consent to a sensitive-data use that requires separate consent.

2. Information we collect

  • Identity and contact information: name, email address, telephone number, shipping and billing addresses, and account identifiers.
  • Transaction and service information: orders, payment status, delivery, subscriptions, product preferences, support communications and returns. Payment providers process full card details; we do not store full card numbers.
  • Reviews and submissions: review text, ratings, images or other content you choose to provide, including content you ask us to display publicly.
  • Device and site information: device and browser type, IP address, general location, referring page, pages viewed, interactions, cookie identifiers and similar technology data.
  • Health-related information: Some information you choose to provide — for example through our product-finder quiz, support messages, or reviews — may relate to your health. We describe how we handle it in our Consumer Health Data Privacy Policy, and we do not share it for advertising.

Quiz information may include the questions presented, raw answers about digestive comfort or wellbeing goals, inferred interests, the recommendation produced, and the identifiers needed to deliver the result. You do not have to provide health-related information to buy our products.

3. Sources

We collect information directly from you; automatically from your browser or device; and from providers involved in payments, ecommerce, subscriptions, delivery, communications, reviews, security and analytics. We may also receive information from an authorized person acting for you or from public sources where law permits.

4. How we use information

  • To process payment, fulfill and deliver orders, manage accounts and subscriptions, and provide support.
  • To generate and deliver quiz results or recommendations you request.
  • To communicate about transactions, services, recalls or safety matters.
  • To send marketing where you have opted in and to record opt-outs.
  • To operate, secure, troubleshoot, analyze and improve the site and services.
  • To prevent fraud, enforce agreements, resolve disputes and comply with law.

5. Processors and first-party providers

We disclose information needed to perform services to processors and providers such as Shopify for ecommerce and accounts; Recharge for subscriptions; payment providers; fulfillment and delivery providers; Klaviyo as a first-party communication provider controlled for Progurt communications; Okendo for reviews; and hosting, support, fraud-prevention and security providers. Their access is limited by the applicable service function and contractual or equivalent controls.

6. Analytics and advertising partners

GA4 and Microsoft Clarity receive de-identified, PII-scrubbed usage information so we can understand site performance and interactions. Advertising partners may receive online identifiers and non-health site interactions where permitted so that we can measure or deliver advertising. Identifiable health information, raw health answers and inferred health interests are not sold or shared for cross-context behavioral advertising and are not sent to advertising pixels.

We do not sell personal information for money. Some disclosure of online identifiers or site activity to advertising partners may be treated as a “sale”, “sharing”, or targeted advertising under certain state laws even when no money is exchanged. Section 9 explains the choices we provide.

7. Public review display and other disclosures

When you submit a review for publication, we and our review provider may publicly display the content, name or nickname, rating and media identified in the review notice. We do not publish a private support message as a review without permission. We may also disclose information where required by law; to protect rights, safety or security; or in connection with a merger, financing, acquisition or sale, subject to applicable protections.

8. Consumer health data

Our Consumer Health Data Privacy Policy describes the categories, sources, purposes, recipients, consent and rights that apply to consumer health data. It is located at https://www.progurt.com/pages/consumer-health-data-privacy and is linked prominently from the homepage. Health-related information is used within Progurt and controlled first-party providers for the requested recommendation, result, support and separately consented first-party communications. Analytics receive de-identified, PII-scrubbed information; identifiable health information is not sold or shared for cross-context behavioral advertising.

9. Your Privacy Choices / GPC

This section is provided as a prudent privacy choice and future-proofing measure. Progurt is currently below the thresholds that make the California Consumer Privacy Act’s business obligations mandatory; we offer these choices voluntarily as a matter of good practice. This section does not replace rights that apply under another state law.

  • Marketing: use the unsubscribe link in a marketing email or email us. Transactional, safety and service messages may continue.
  • Targeted advertising: use the privacy-preference control made available on the site or email us with the subject “Privacy Choices”. Your choice is applied as required to the browser, account or known identifier associated with the request.
  • Browser controls: you can also manage cookies through browser or device settings, although disabling essential storage may affect site functions.

We will not discriminate against you for exercising an applicable privacy right.

10. U.S. privacy requests

Depending on your state and the processing involved, you may have rights to confirm processing; access, correct, delete or obtain a portable copy of information; opt out of sale, sharing, targeted advertising or certain profiling; withdraw consent; appeal a denied request; or use an authorized agent. Email support@progurt.com with the subject “Privacy request”. We will verify only as reasonably necessary, will not require you to create a new account, and will respond within the period required by applicable law. 11. Cookies and similar technologies

We use essential technologies to operate the site; preference and analytics technologies to remember choices and understand use; and, where permitted, advertising technologies to measure or deliver advertising. The controls in section 9 apply according to the technology and law. Cookie settings are not a substitute for the separate consent required before collecting health-related quiz answers.

12. Retention, deletion and security

We retain information only while needed for the disclosed purpose, a legal or accounting obligation, dispute resolution, fraud prevention, or enforcement. We then delete it securely or de-identify it, including through relevant providers where appropriate. Backups are isolated from ordinary use and expire or are securely overwritten under the applicable schedule.

We use safeguards proportionate to the information, including access controls, authentication, provider diligence, contractual restrictions, transmission protections, monitoring and incident-response processes. No method of transmission or storage is completely secure.

13. Children

The site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from a child under 13. Contact us if you believe a child has provided information so we can investigate and delete it where required.

14. International processing

If you use the U.S. site from another country, information may be processed in the United States and other countries whose laws differ from those where you live. We apply the protections described in this policy and any protections required by applicable law.

15. Changes to this policy

We may update this policy prospectively and will post the revised version. We will provide direct notice where reasonably practicable or legally required before a material new use takes effect, and obtain new consent where a materially different purpose or sensitive-data use requires it.
